Are Tomatoes Fruits Or Vegetables?

In Nix  v. Hedden (1893) the Supreme Court ruled that tomatoes were vegetables, not fruits.  Good thing, or who knows how V8 would be marketed.  Somewhat more factually problematic is this decision from the Minnesota Court of Appeals ruling that BB guns are firearms.  From Sept. 28, 2015 Star-Tribune:

A small BB gun found in a felon’s car has been ruled a firearm by the Minnesota Court of Appeals, and its possession means more prison time for him.

Since 1977, the state’s two appellate courts have repeatedly agreed with the Legislature that a BB gun is a firearm when involved in various crimes, such as drive-by shootings.

As the result of a 2005 felony drug conviction, David Lee Haywood wasn’t supposed to have a handgun. The BB gun was found in his glove compartment during a traffic stop in 2013.

He was found guilty of a felony in Ramsey County District Court and received a mandatory minimum of five years in prison.

Now if he had threatened someone with it, there might be some argument for this, but it reminds of when I lived in California and I called our local police department to see if there was a legal problem, with firing a bow and arrow in my back yard.  They informed me that under California law, a bow and arrow is a firearm.  Don't know where they found that definition.

I Guess HHS Isn't Buying the White House Assurances About the Iran Treaty

(CNSNews.com) - "The detonation of an improvised nuclear device would produce intense heat, resulting in many patients with severe burns," says a September 30 news release from the Department of Health and Human Services.

The announcement says HHS has contracted for the development of "four novel products to treat severe thermal burns."

The products will boost the number of treatment options in case of disaster, and they'll also be used in "routine" burn care situations.

The four treatments -- one commercially available right now and three in development -- "will be added to the Strategic National Stockpile (SNS) or managed by vendors to help protect people from burn injuries resulting from radiological and nuclear threats," HHS said.

A 26-year-old gunman singled out Christians for slaughter during a rampage at an Oregon community college Thursday, leaving at least 9 people dead and many more wounded, survivors and authorities said.

“The shooter was lining people up and asking if they were Christian,” tweeted “@bodhilooney,” who said her grandmother was inside the Umpqua Community College classroom that was the scene of the 10:40 a.m. carnage.

“If they said yes, then they were shot in the head. If they said no, or didn’t answer, they were shot in the legs.”

A gun-free zone of course.  There is some evidence the shooter was a Black Lives Matter supporter.

What a surprise:

Mercer’s California neighbors also spoke of his relationship with his mother, Laurel Harper. The two lived together in Torrance, California, and several of their neighbors interviewed by the Times said they were very close.

Julia Winstead recalled a day where Harper appealed to their neighbors to sign a petition to urge her landlord to exterminate their one-bedroom apartment for cockroaches.

“She said, ‘My son is dealing with some mental issues, and the roaches are really irritating him,’” Winstead said.

The U.S. and Russian militaries were due to hold talks via video link to seek ways to keep their militaries apart as they wage parallel campaigns of air strikes in Syria, a U.S. defense official said.

Russian jets struck targets near the cities of Hama and Homs in western Syria on the second day of their air campaign.

Moscow said it had hit Islamic State positions, but the areas it struck are mostly held by a rival insurgent alliance, which unlike Islamic State is supported by U.S. allies including Arab states and Turkey.

Secret Service official wanted to embarrass congressman

An assistant director of the Secret Service urged that unflattering information the agency had in its files about a congressman ­critical of the service should be made public, according to a government watchdog report released Wednesday.

“Some information that he might find embarrassing needs to get out,” Assistant Director Edward Lowery wrote in an e-mail to a fellow director on March 31, commenting on an internal file that was being widely circulated inside the service. “Just to be fair.”

Two days later, a news Web site reported that Rep. Jason Chaffetz (R-Utah), chairman of the House Oversight and Government Reform Committee, had applied to be a Secret Service agent in 2003 and been rejected.

That information was part of a Chaffetz personnel file stored in a restricted Secret Service database and required by law to be kept private.
